Terms and conditions for the supply of services
Acceptance
The document represents the terms and conditions governing the relationship between Oxford Comma Advisory Ltd. trading as “Oxford Comma” (hereafter “the Company”, or “Oxford Comma”, or “oxfordcomma.uk”) and the clients.
By making a purchase from the website oxfordcomma.uk or via offline payment you agree to the following Terms and Conditions for the Supply of Services (hereafter “the Agreement”):
The terms and conditions of this Agreement apply to all services purchased via the website oxfordcomma.uk or paid via offline payment to Oxford Comma, provided by the Company to you directly and performed by any of the Company’s consultants in person or remotely via collaboration/conference platforms, unless agreed otherwise by both parties in advance, in writing (hereafter “the Services“).
Should you fail to make payment in full, the Company reserves the right to terminate this Agreement without notice and discontinue provision of any or all Services.
Appointments: Some of our Services will require a date and time to be agreed (hereafter “the Appointment”). Our team will reach out to you through your preferred communication channel (e.g., email, phone, or SMS - as provided during registration, or agreed otherwise) to confirm appointment details in advance.
Non-Financial Liability: While we take our commitment to providing services seriously and honouring appointments on time, there may be unforeseen circumstances beyond our control that could lead to a missed or rescheduled appointment. Despite our best efforts, we cannot guarantee that appointments will never be subject to changes.
Mitigating Circumstances: In the event that an appointment needs to be rescheduled or cancelled, we will make all reasonable efforts to notify you as soon as possible and offer alternative appointment options. Our team will work with you to find a suitable solution that meets your needs.
Customer Responsibility: We kindly request that you confirm your appointment with us as well, either by responding to our confirmation message or by contacting our customer support team. This helps us ensure that all appointments are accurately scheduled and that any necessary adjustments can be made promptly.
No Financial Liability: Please note that we shall not be held financially liable for any direct or indirect losses, expenses, or damages incurred due to a missed appointment or any changes to the appointment schedule. This includes but is not limited to travel costs, accommodation expenses, or any other related expenses.
Appointment Rescheduling: If you need to reschedule your appointment, we request that you provide us with reasonable notice. You can contact our customer support team for assistance with rescheduling your appointment.
- In the event of you being late for the appointment for more than 20 minutes the service will be cancelled and no refund will be provided to you. For Meet & Greet services we recognise that flights may be delayed en-route and this time so we will endeavour to make reasonable provisions as long as you have confirmed your travel itinerary with us within 48 hours of the scheduled arrival time
- You may change the time of your appointment up to 24 hours prior to the scheduled start time. In the event of you postponing the agreed session less than 24 hours before the scheduled time, the session will be cancelled and no refund will be provided to you.
Force Majeure: In situations of force majeure, such as natural disasters, strikes, or other events beyond our control that could disrupt our operations, we reserve the right to reschedule appointments without incurring any liability.
Discounts Policy
Any discounts are offered at the discretion of the Company only and will be valid for a limited time, which should be clearly stated by authorised publications of the Company. The Company reserves the right to cancel the discount offer at any time with no reimbursement.
- Eligibility: Discounts are available to eligible customers as specified in the promotional offer or based on predetermined criteria. These criteria may include, but are not limited to, first-time customers, loyal customers, specific products or services, and limited-time promotions.
- Validity Period: Each discount offer will have a specified validity period during which it can be redeemed. Customers must avail the discount within the designated timeframe to be eligible for the reduced price or special offer.
- Exclusive Use: Unless otherwise stated, discounts are non-transferable, non-exchangeable, and cannot be combined with any other ongoing promotions, offers, or discounts. Each discount is intended for the exclusive use of the individual or entity to whom it was issued.
- Promotion Codes: In cases where discounts are applied using promotion codes or coupon vouchers, customers must enter the valid code during the checkout process to enjoy the discount. Failure to provide the correct code may result in the forfeiture of the discount.
- Discount Limitations: Discounts apply only to the eligible products or services specified in the offer and cannot be used for the purchase of gift cards, third-party products, or other excluded items. The discount value is not redeemable for cash or credit.
- Refunds and Adjustments: If a customer is eligible for a discount but forgets to apply it during the purchase process, we regret that we cannot provide retroactive adjustments or refunds once the transaction is complete.
- Modification or Termination: We reserve the right to modify or terminate any discount offer at our discretion without prior notice.
- Abuse of Discounts: We monitor discount usage to prevent misuse or abuse. We reserve the right to refuse or cancel a discount if we suspect fraudulent activity or violation of these terms and conditions.
- Applicability: The terms and conditions of our discounts are subject to the laws and regulations applicable in the jurisdiction where the transaction takes place.
Right to Cancel
You have a statutory right to cancel any purchased Service within 14 days of purchase. The cancellation period will expire after 14 days from the day of the payment.
No Refunds After 14 Days: Please note that no refunds will be issued for cancellations made after the 14-day period.
To exercise the right to cancel, you should contact us in writing before the cancellation period has expired on [email protected] and inform us of your decision.
- Digital Services: If the service that you purchased includes digital content (e.g. e-Course) - by accessing or downloading the item within 14 days of purchase you have taken ownership and you confirm that you lose your 14 day right to cancel.
- If you have technical issues with the product or you can't download the files contact Oxford Comma on [email protected] and we will help you as soon as possible.
- Appointments: Cancellation of Coaching Sessions or Meet & Greet services within 14 days of purchase is also subject to the Appointment Rescheduling policy. Should you schedule and miss your appointment within 14 days of purchase - this will count as you have consumed the service.
- Promotions Codes & Discounts - in the event of a cancellation, any promotions or discounts applied as point of purchase shall not be reinstated, nor shall the client be refunded the monetary value of the discount amount.
Fair Use Policy for Student Care Chat
- Access and Usage:
- Registered clients have unlimited access to our services during their engagement with us.
- The service is available during working days, while out-of-hours is for emergencies only.
- Usage should pertain to study abroad needs, including academic support, cultural integration, and student visa advice. Please visit the Student Care Chat page for a complete list of categories.
- We reserve the right to decline a client's query if we suspect that the request does not fit within the framework of this fair use policy.
- Resource Allocation:
- To ensure equitable access, there may be limitations on concurrent consultation sessions or priority given to urgent inquiries.
- During peak times, priority will be given to academic-related queries.
- Prohibited Activities:
- Any use of our services for illegal or unethical purposes, such as cheating, plagiarism, or visa fraud, is strictly prohibited.
- Non-study abroad matters (e.g., unrelated personal issues) should be avoided.
- In an emergency (medical or otherwise), this service does not replace Emergency Services. Always call 999 (in the UK) first and follow the instructions provided.
- Monitoring and Enforcement:
- Our consultancy may monitor usage patterns to identify potential misuse.
- Violations may result in warnings, temporary suspension, or termination of our services, depending on the nature and frequency of the breach.
- Transparency:
- This fair use policy is communicated clearly to all clients during the purchasing process and is subject to periodic review.
- Any updates to the policy will be communicated in advance.
- Feedback and Appeals:
- We encourage clients to provide feedback on our services and report any issues.
- A process for appealing decisions related to policy violations will be available.
- Resource Optimization:
- We will make reasonable efforts to allocate our resources efficiently to meet the needs of our clients within normal business hours.
- Duration of Support:
- Our study abroad support services will be available for the duration of the clients' engagement with our consultancy, as defined in our agreement.
- Good Faith Usage:
- We encourage all clients to use our services in good faith, respecting both the policies and the needs of other clients.
This fair use policy is designed to ensure that our study abroad support services remain accessible and beneficial to all our clients while preventing misuse or abuse of our consultancy's resources.
Guarantees and limitations of liability
By making a purchase from the website oxfordcomma.uk you agree that the Services provided by The Company are suitable for your requirements. The Company will use all reasonable skill and care in the preparation and delivery of its Services as specified on the Services page of the Company’s website oxfordcomma.uk. All other warranties, guarantees and representations whether express or implied, statutory or otherwise are excluded.
The Company’s liability for any loss and/or damage arising from the performance of the Services shall be limited to the nominal value of the Company’s share capital. The Company is not liable for any loss and/or damage that is not directly connected to the Company’s performance of the Services.
The Company shall not be responsible for indirect, special or consequential loss (including loss of anticipated profit or data), howsoever arising even if it is been advised of the possibility of such potential loss in a reasonable manner.
Except (not limited to) a claim for non-payment under this Agreement, no action regardless of form arising out of the provisions of The Company’s Services may be brought by either party more than two years after the cause.
The Company has the right to refuse service provision where there are any reasonable doubts about identity, qualifications or if your behaviour is unacceptable including but not limited to physical or verbal aggression, behaviour or language that causes staff or other clients to feel afraid, threatened or abused.
Technical requirements
The client will be required to have a laptop or desktop computer and access to broadband or a data connection in order to engage with the Services.
Copyright
The copyright and all other intellectual property rights of all Services performed and all materials developed (including but not limited to brochures, checklists, manuals, instructions, help-books, articles, videos, blog posts) shall remain the sole and exclusive property of the Company.
All original material (text, images, videos and links) on the Company’s website is the sole property of the Company.
You accept that you shall not:
- copy or permit the copying of session notes, any materials;
- disclose or permit disclosure or sell or hire the same to third parties;
- use the same for running your own courses unless the express written permission of the Company.
Any content used from a third party remains the property of the third party.
Privacy Policy
The Company reserves the right to store cookies and track some information that can be used for advertising with compliance with the Data Protection Act and relevant legislation. The Client acknowledges that there might be third-party cookies and tracking used by the Company’s advertisers left on their computer.
No personal information that is provided by you to the Company will be shared with 3rd Parties unless this is required for the provision of contracted Services. All information provided by you will only be used by the Company to contact you and possibly send any discounts/offers and useful articles related to your query with the Company.
Miscellaneous
By making a purchase from the website oxfordcomma.uk you agree with the following:
This Agreement constitutes the entire agreement between the parties in relation to the Services provided by the Company to you and supersedes any and all prior agreements, discussions, understandings, representations or promises. Each party warrants to the other that it has not relied upon any representation not recorded here which has induced it to enter into this Agreement. No amendment to this Agreement will be valid unless confirmed in writing by authorised signatories of both parties on or after the date of this Agreement.
No delay or forbearance by either party in enforcing its respective rights will prejudice or restrict the rights of that party and no waiver of any such rights or of any breach of any contractual terms will be deemed to be a waiver of any other right or any later breach.
Neither party will assign or transfer all or any part of this Agreement without the prior written consent of the other party except that assignments of associated companies of the Company are permitted.
In the event that any of the provisions of this Agreement is judged illegal or unenforceable, the continuation in full force and effect of the remainder of them will not be prejudiced.
Neither party will be liable to the other for any delay in performing its obligations under this Agreement (other than a payment of money) where such delay results from force majeure, act of God, fire, explosion, accident, industrial dispute or any other cause beyond the reasonable control of the Company. If due to force majeure, some or all of the Services are not provided, you might be entitled to a partial refund for those Services.
Any notice given under this Agreement by either party to the other must be in writing and may be delivered personally or by recorded delivery or registered post and in case of post will be deemed to have been received on the third working day after the date of posting. Notices must be delivered or sent to the address of the parties on the Order or Order Acceptance or to any other address in writing by either party to the other after the date of this contract. This contract is governed by English Law and the parties submit to the non-exclusive jurisdiction of the English Courts.
The waiver by either Party of a breach, default, delay or omission of any of the conditions of this Agreement by the other Party will not be construed as a waiver of any subsequent breach of the same or other provisions.
For the purposes of this Agreement words in the singular mean and include the plural and vice versa. Words in the masculine include the feminine gender and vice versa. Words in the neutral gender include the masculine gender and the feminine gender and vice versa.
Amendments and Modifications:
Oxford Comma reserves the right to modify or update the terms and conditions at any time. Clients will be notified of any changes via email.
